1. Your access to and use of HOSTNOC.com (the “Website”) and any pertaining Services, is subject exclusively to these Terms of Use (“TOU”). You will not use the Website/Services for any purpose that is unlawful or prohibited by these TOU. By using the Website/Services, you are fully accepting the terms, conditions and disclaimers demarcated in this notice.
2. We reserve the right to update or amend these TOU at any time, and your continued use of the Website/Services following any changes are subjected to your consent to such change. It is, therefore, your responsibility to check the TOU regularly for any alterations.

THE SERVICES

The Website may provide a variety of resources such as e-mail, forums, and product information (collectively “Services”) designed to assist you and to enable you to communicate with us and/or other visitors to the Website. Unless stated otherwise, the Services are for your personal and non-commercial use only.

USER ACCOUNT, PASSWORD & SECURITY

1. If a particular Service entails you to sign up for an account, you will be required to complete the registration process by providing certain information and registering a username and password for use with that Service.
2. You are responsible for maintaining the confidentiality of the username and password and also exercise discretion for all activities which take place under your account. 4. You may not use another person’s account at any time, without the express permission of the account holder and HOSTNOC.

ACCEPTABLE USE

You acknowledge that all information, text, graphics, logos, photographs, images, animations, sound, illustrations and other materials (“the Content”), whether posted publicly or transmitted privately, is the sole responsibility of the creator. We do not control or endorse the Content and cannot guarantee the accuracy, integrity or quality of such Content.
2. In using our Website/Services, you agree not to:
   1. Use the Services to send junk email, spam, chain letters, pyramid schemes or any other unsolicited messages, commercial or otherwise.

   7. Attempt to gain unauthorized access to any of the Services, accounts, computer systems or networks connected to the Website/Services through hacking, password mining or any other means.
   8. Any other abusive services causing disruption in our operations (including inbound and outbound attacks / etc.)
   9. Use of HOSTNOC service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as “pyramid schemes,” and “chain letters” is strictly prohibited.

Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property

TERMINATION

We have the right to terminate your access to any or all of the Services at any time, without notice, for any reason, including, but not limited to breach of these TOU. We may also at any time, at our sole discretion, discontinue the Website/Services or any part thereof without prior notice, and you agree that we shall not be liable to you or any third party for termination of your access to the Website/Services.

MONEY BACK

If for any reason you wish to cancel your account within the first 15 days of setting up the account with us, we will issue a full refund (minus the setup fees and surcharge charges) with no questions asked for shared accounts only (review below for details). To request a refund, you will need to submit the Cancellation request from the billing portal. Please note that a 15-day money back guarantee applies to only shared and reseller hosting accounts and do not include the below-mentioned services:

1. Dedicated server / Cloud Server /Any Other VPS (Virtual Private Servers)
2. SSL Certificates
3. Any add-ons like Additional domains, Databases, Backups, Dedicated application pools and/or any of the hosting add-ons/plan-upgrades.
4. Any other services/add-ons, except base shared hosting accounts

We do not entertain pro-rated refund requests issued after 15 days of service. Accounts which had been terminated due to a violation of any of HOSTNOC Terms and conditions will not be eligible for any kind of refund. Additionally, accounts with any pending dues or over-usages will not be eligible for any refunds.

DISCOUNTS / SPECIAL PRICES

Any discounts/specials / promotional prices displayed on our website will be subjected to specific terms and their availability is limited to the mentioned dates only. Please note that these discounts/specials cannot be used to replace any of your existing subscribed services. Failing to comply can result in a discontinuation of any applied discounts/specials, and you will be billed at the full retail rates for the given service.

DATA INTEGRITY

The subscriber is responsible for keeping a complete and current copy of their website files as a backup on a remote system (not solely on the HOSTNOC servers). HOSTNOC is NOT RESPONSIBLE for any lost files, information or data. Although HOSTNOC backups may include subscriber sites and information for disaster recovery purposes, these backups are not to be relied on by the subscriber.

INDEMNITY

You agree to indemnify and hold the HOSTNOC Website harmless from and against any breach by you of these TOU and any claim or demand brought against the Website by any third party arising out of your use of the Services and/or any Content submitted, posted or transmitted through the Services, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) in whatever way suffered or incurred by the Website in consequence of your breach of these TOU.

ABUSIVE BEHAVIOUR

HOSTNOC reserves the right to suspend/terminate client’s account if the client engages in any abusive behavior, including making threats, using derogatory or abusive language, complaining against HOSTNOC or its staff members, or making any public defamatory remarks on forums/blogs/websites.
